Don't Break The Law! You May be Involved in an Illegal Transaction
Counties and other Public Entities recognize that legel requirements for providing inmate medical coverage force them to assume a tremendous amount of risk. Many inmates require medical attention (Frequency of Risk) and severe and costly illnesses and accidents occur while the inmates are in custody (Severity of Risk).
Now these Public Entities are attempting to transfer some, or all of, that risk. They are transferring this risk to the Medical Management Companies who are managing inmate treatment. Depending on the locality and State, this may be an illegal transaction!
Only regulated insurance companies are authorized to accept risk in most states. These regulations are established to make sure the money is there to pay claims when they happen. Medical Management Companies are not licensed to accept this transfer of risk.
In your current contractual relationships, if you transfer this risk (Public Entity), or accept this transfer of risk (Medical Management Companies) you should obtain legal advice to determine whether or not you are involved in an illegal transaction.
